New Polk roofs: the short version

Permits submitted before December 31, 2026 follow the 2023 Florida Building Code, Eighth Edition; from that date, the Ninth. Every new roof passes a sheathing or dry-in inspection and a roofing inspection. A general contractor must hand roofing to a roofing contractor unless it is putting shingles on a building of its own construction.

Where Polk is building, by the numbers

Polk went from 725,046 people in the 2020 Census to an estimated 874,790 in July 2025, up 20.7%. Housing followed: 316,381 units in the 2020 Census and 340,748 in the 2020-2024 American Community Survey.

The new stock is uneven. Countywide only 17.9% of homes date to 2010 or later, but Polk City is at 47%, Haines City at 33% and Four Corners, the four-county community listed under Osceola County, at 34%. Davenport and Haines City run their own building departments; Polk City's permit page could not be read during research, so builders there should check with the town.

Code

Which code edition, and the inspections in order

A Polk permit filed today is reviewed under the Eighth Edition, in force since December 31, 2023. Applications and plans submitted on or after December 31, 2026 must meet the Ninth, so a subdivision whose later phases are permitted in 2027 can be built to a newer book than its first homes.

FBC-B 110.3 lists the inspections in sequence: foundation; framing once trusses, bracing and connectors are set; sheathing, alone or folded into a dry-in check; exterior wall coverings and soffit in progress; roofing, covering dry-in, insulation, coverings and flashing; then the final.

Dry-in on a shingle or metal roof can follow any of three paths in R905.1.1.1: fully adhered ASTM D1970 membrane on the whole deck; a 3 3/4-inch membrane strip or AAMA 711 tape over each sheathing joint with underlayment above; or two layers of felt-type underlayment held by cap nails 12 inches apart in the field and 6 at the laps. Sheathing goes down with RSRS-03 ring-shank nails in most cases, and shingle drip edge is nailed every 12 inches, or every 4 where the allowable-stress wind speed reaches 110 mph or the roof stands over 33 feet.

Who may roof a new Polk home, and Florida's one-year builder law

General, building and residential contractors must subcontract roofing unless they hold a roofing certificate or registration (Fla. Stat. 489.113(3)). The one carve-out lets them install asphalt or fiberglass shingles on a new building of their own construction; tile, metal and membrane roofs go to a roofing contractor.

Florida's builder law, Fla. Stat. 553.837, in effect since July 1, 2025, makes the builder responsible for one year for construction defects in equipment, material or workmanship that amount to a material code violation. It does not cover normal wear, settling, damage the owner causes or natural disasters.

At the final walkthrough, look at the eaves. Where an overhang is under 6 inches, R318.5 requires gutters with downspouts, and every downspout must discharge at least a foot from the wall. FEMA's Hurricane Michael advisory traced heavy water damage to failed soffits, which is why the 2007 code began requiring soffits to resist wall-level wind loads.

Will a Polk home permitted in 2027 face a different code?

Yes. The Ninth Edition of the Florida Building Code applies to every permit application and plan set submitted on or after December 31, 2026; earlier submissions stay under the Eighth Edition, which took effect December 31, 2023. In a county that added an estimated 149,748 residents between April 2020 and July 2025, plenty of subdivisions will have phases on both sides of that date, so builders and buyers should confirm which edition each permit was reviewed under.

Can a builder in Davenport or Haines City install its own roof?

Shingles, yes, but only on a house it is building itself. Fla. Stat. 489.113(3)(b) lets a general, building or residential contractor install wood shingles or shakes, or asphalt or fiberglass shingles, on a new building of its own construction; tile, metal and membrane roofs must go to a roofing contractor. A general contractor whose certificate dates after 1973 may not advertise as a roofer without a roofing certificate or registration. Davenport, where 71% of housing units date to 2010 or later, and Haines City both issue their own permits for that work.

What does Florida's builder law cover on a new Polk County roof?

A roof defect counts if it comes from equipment, material or workmanship supplied by the builder or its subcontractors and amounts to a material violation of the Florida Building Code, found within 1 year of the first owner's title transfer or move-in, whichever comes first. Leaks from settling, normal wear, owner damage or a natural disaster fall outside it. Polk's storm record makes that last exclusion matter: Milton gusted to 87 mph at Winter Haven in 2024. Keep the permit and inspection records for the house.

Can a Polk County builder use a private inspector?

Yes, with the owner's written authorization. Under Fla. Stat. 553.791, the fee owner of a building, or the owner's contractor with explicit written permission, may hire a private provider for plan review or building code inspections at any time; the provider must be a building code administrator, engineer or architect holding the state license for that role. In Polk the permit itself still comes from the city, such as Davenport or Haines City, or from the Polk County Building Division for unincorporated land.
