Where Hillsborough is building, and which code edition applies

Growth here leans south and east. Riverview added more than 36,000 residents between the 2010 and 2020 censuses, Brandon went from 103,483 to 114,626, and the Census Bureau's 5-year estimate puts the county at 1,522,748 people against 1,459,762 counted in 2020.

The 2023 Florida Building Code, 8th edition, took effect December 31, 2023. The 9th edition takes effect December 31, 2026, and every permit application and plan submitted on or after that date must comply with it. For a lot or subdivision near that line, the submission date sets the edition.

Under shingles or metal, the residential code allows three dry-in methods: a fully adhered ASTM D1970 membrane over the whole deck, taped deck joints under an approved underlayment, or two layers of felt-type underlayment fastened on a set pattern (R905.1.1.1).

The lot's location decides who inspects. Tampa, Temple Terrace and Plant City inspect inside their limits, and Hillsborough County Building Permits & Records covers new subdivisions in unincorporated areas such as Riverview and FishHawk. Under Fla. Stat. 553.791, an owner, or a contractor with the owner's written authorization, may also use a private provider for plan review or inspections.

Roofing subcontracts and Florida's new-home builder law

A general, building or residential contractor must subcontract the roofing unless it holds a roofing certificate or registration. The one carve-out lets it install asphalt or fiberglass shingles itself on a new building of its own construction; tile, metal and membrane roofs go to a roofing contractor (Fla. Stat. 489.113(3)).

Buyers get a statutory floor. Since July 1, 2025, Fla. Stat. 553.837 has required a builder to warrant a newly built home for 1 year against defects in equipment, material or workmanship that materially violate the Florida Building Code, excluding normal wear, settling, owner-caused defects and acts of God such as a natural disaster.

Many of the county's newest houses sit in planned communities with their own districts and associations, such as FishHawk Ranch, where residents pay a Community Development District fee.

Which building code edition applies to a new home in Hillsborough County?

It depends on when the permit application goes in. The 2023 Florida Building Code, 8th edition, has applied since December 31, 2023, and applications and plans submitted on or after December 31, 2026 must meet the 9th edition. With 18.6% of the county's homes already built since 2010 and new subdivisions still filling in around Riverview and Brandon, plenty of projects will straddle that date, so confirm the edition with the office that will permit the lot.

Do new homes in Hillsborough County need gutters?

Only where the eaves are short, by code. The residential code requires gutters with downspouts on buildings whose eaves project less than 6 inches, except at gable-end rakes or a roof above another roof, and the downspouts must discharge at least 1 foot from the wall (R318.5). Even where they are optional, Hillsborough's summer rain argues for planning them: Tampa International Airport averages 49.48 inches a year, about 61% of it June through September.

Can I act as my own contractor on my Hillsborough home?

Florida's owner-builder exemption lets an owner who personally supervises the work act as their own contractor to improve a one- or two-family residence for their own use (Fla. Stat. 489.103(7)). The roof still needs its permit and inspections from the office that covers the lot: Hillsborough County Building Permits & Records in unincorporated areas, or the city building department in Tampa, Temple Terrace or Plant City.

The statute carves out ordinary wear, settling, defects the owner caused, and acts of God like a natural disaster.
