Code and timing

Why a newer roof here follows the current code

Most of this community was built well before the newest codes. Many roofs here are likely from the 1960s through the 1980s, when the original subdivision went up. That suggests a full replacement will fall under whatever edition is in effect on the day the permit is filed.

December 31, 2023 is the date the 2023 Florida Building Code, Eighth Edition, became enforceable. Permit applications filed on or after December 31, 2026 will need to comply with the Ninth Edition, which goes into effect that day. A roof permitted this year and a roof permitted next year may face different rules.

Materials and dry-in

Deck, underlayment and fastening on a new roof

Roof sheathing has to be fastened with specific ring shank nails. The code names RSRS-03 nails for most decks, with RSRS-01 or RSRS-04 allowed where sheathing is 15/32 inch or thinner. Your roofer should be able to show these nails on the job before the sheathing inspection.

  • Self-adhering polymer-modified bitumen over the entire deck, or
  • A 3 3/4-inch strip over each deck joint with approved underlayment over the roof, or
  • Two layers of approved felt-type underlayment fastened to the code spacing

Shingle roofs need drip edge at the eaves and gables. Where design wind speed is 110 mph or more, or the mean roof height exceeds 33 feet, the drip edge is fastened every 4 inches on center instead of every 12.

Inspections and paperwork

Scheduling the roof with inspections and product approval

Inspectors work through the roof in a fixed sequence. Framing must be done before the roof sheathing inspection, and the roofing inspection covers dry-in, insulation, roof coverings and flashing before the final. Schedule the roof around these stops so the house does not sit waiting.

Statewide product approval is required for every roofing product in Florida. Check the approval number on the product against the Florida Building Commission lookup before it goes on the permit. Permit applications for Hillsborough County should be confirmed with the county building office, which issues permits for this unincorporated area.

Questions

New construction roofing in Town 'n' Country: questions

What is the 25% roof rule in Florida?

The 25 percent rule limits how much of an existing roof can be repaired or replaced in any 12-month period without bringing the whole roof up to current code. Not more than 25 percent of the roof area can be replaced in that window unless the entire roof system is replaced. Town 'n' Country has 35,649 housing units, many with older roofs, so this rule matters here. Confirm your exact case with the Hillsborough County building office.

What is the new law in Florida about roofs?

For new homes, Florida Statute 553.837 requires a builder to warrant a newly constructed home for 1 year against defects in equipment, material or workmanship that violate the Florida Building Code. The law took effect July 1, 2025 and excludes normal wear and tear and natural disasters. For Town 'n' Country homes, only 6.6 percent were built in 2010 or later, so most roofs here fall outside this rule. Ask your builder or the county for the exact terms.

Does a roof permit in Town 'n' Country go through the county?

Yes. Town 'n' Country is an unincorporated census-designated place, so the Hillsborough County building office issues roof permits. The county permit site is the place to check status and requirements. Permit clocks matter: a permit can become invalid if work does not start within 6 months of issuance. Confirm current requirements directly with the county before you schedule work.
