Why a 1996 roof gets the full treatment

Florida limits patching to 25% of a roof or roof section in any 12 months unless the whole section is brought up to code (R908.1.1). The way out is a roof built to the 2007 code or later, and that code did not take effect until March 1, 2009 (553.844(5)). With 53.8% of Tavares housing built before 2000, most first-generation roofs here fall on the old side of that date.

The deck gets its own check once the old covering is off. Plywood or OSB held by staples or 6d nails gets ring-shank nails added at 6 inches or closer, and a secondary water barrier goes over the deck before the new covering (R908.7.1 and R908.7.2).

Newer houses are a different case. 26.9% of Tavares units were built in 2010 or later; if yours is one of them and the roof is still original, a partial repair can stay partial.

Inside the city limits, the City of Tavares Community Development office issues the re-roof permit. Its Roofing Permit packet is posted online, and finished forms go to the permits office by email. Outside the limits, the job goes to Lake County's Office of Building Services.

A re-roof skips plan review (FBC-B 107), but it gets two inspections: the sheathing and its fasteners, usually at dry-in, and the final roofing inspection of dry-in, insulation, coverings and flashing (FBC-B 110.3). Applications submitted on or after December 31, 2026 fall under the 9th edition of the code.

Storms are why these rules exist. FEMA declared Lake County a disaster area for Irma in 2017 (DR-4337), Ian in 2022 (DR-4673) and Milton in 2024 (DR-4834), and Milton alone left 8.55 inches at Tavares.

Can new shingles go over my old roof in Tavares?

It depends on the roof, and the code's own text leaves much of the question to the building department. In the 8th edition, the residential code's roof re-cover sections read 'Reserved'. R908.3 still requires removing every existing layer when the old roof is water-soaked or too deteriorated, when it already has two or more layers, when it is wood shake, slate or tile, or when blisters remain. Whether the City of Tavares Community Development office accepts a recover on a given house is its call, so ask before you plan one. On a 1996-era roof, a tear-off also lets the deck be re-nailed.

My Tavares home was built in 2012. Does the 25% rule still apply?

Usually not in its strict form, as long as the roof dates from the house. If a roof was built, repaired or replaced to the 2007 Florida Building Code or a later edition, only the part being repaired, replaced or recovered has to meet today's code, even when that part is 25% or more (Fla. Stat. 553.844(5)). No local ordinance may amend that exception. The 2007 code took effect March 1, 2009, so an original roof on a 2012 house went on under it or a later edition. That covers a real share of the city: 26.9% of Tavares housing units were built in 2010 or later.

How long does a Tavares re-roof permit stay valid?

Six months from issue if the work never starts. Under FBC-B 105.4.1, a permit becomes invalid unless work begins within 6 months of issuance, or if the work is suspended or abandoned for 6 months. A job counts as in active progress when the permit has passed an inspection within 180 days. An application left unpursued for 180 days is treated as abandoned, though 90-day extensions are possible. The City of Tavares Community Development office can tell you where a given permit stands.
