What does Florida's new-home warranty law cover in On Top of the World?
Fla. Stat. 553.837, in force since July 1, 2025, makes a builder warrant a newly built home for 1 year against defects in equipment, material or workmanship that cause a material violation of the Florida Building Code. The year starts at the first title transfer or first occupancy, whichever comes first. Normal wear, settling, owner-caused defects and acts of God such as a natural disaster are excluded. With 41.2% of homes here built since 2010, buyers of the newest ones should mark that year on the calendar for roof defects.
How can a buyer check the roof on a new On Top of the World home?
Start with the paper trail. The permit from Marion County Building Safety should show the sheathing and roofing inspections passed, in the order FBC-B 110.3 lists them. Roofing products need Florida product approval, and the Florida Building Commission's public search finds them by FL number or manufacturer. On a shingle roof, drip edge belongs at the eaves and gables over the underlayment. Ask the builder which of the three dry-in methods went under the covering.
Do new homes in On Top of the World need gutters?
Only where the eaves project less than 6 inches. FBC-R R318.5 requires gutters and downspouts on those buildings, except at gable-end rakes or a roof above another roof, and the downspouts must discharge at least 1 foot from the wall. With NOAA Atlas 14 putting the 100-year, five-minute burst here at 13.7 inches an hour, owners who skip gutters should know where that water will land.
