What a 1978 build year means at tear-off

Most Clearwater houses went up under the local codes that came before Florida's statewide building code took over on March 1, 2002; 84.1% of the city's homes predate 2000 and only 6.5% date from 2010 or later. On most re-roofs here, the question is not only the shingles but what sits under them.

The residential code first decides whether a new covering may go over the old one. It may not, and the job becomes a full tear-off, when the existing roof (FBCR R908.3):

  • already has two or more layers of any covering
  • is water-soaked or too deteriorated to hold a new covering
  • has blisters that are not cut open and secured
  • is wood shake, slate, clay, cement or asbestos-cement tile

After tear-off, a wood deck must meet the re-roof fastening rules and get a secondary water barrier (FBCR R908.7). On a 1978 house that can mean supplemental ring-shank nails at 6-inch spacing and, under the new covering, a full self-adhered membrane or taped deck seams.

Permit

Re-roof permits for every address in the city, Clearwater Beach included, come from the City of Clearwater's Permitting office. Plans review is not required for a re-roof, but a sheathing inspection and a roofing inspection are (FBC-B 107, 110.3).

The date of the roof you have now matters for later repairs. Florida's 25% rule limits patching to a quarter of a roof section in 12 months unless the whole section is redone, but a roof built to the 2007 code or later only needs the repaired part brought up to code (Fla. Stat. 553.844(5)). The 2007 code took effect March 1, 2009. A Clearwater roof replaced before then does not get that exception; a roof replaced now will.

Near the shore, ask about roof-to-wall connections. In the wind-borne debris region, a re-roof on a site-built single-family home above a set value must add improved connections when the gable ends or corners can be done for 15% of the re-roof cost (Fla. Stat. 553.844). Beach houses, where Debby put a 55-knot gust in 2024, are the first to check.

Does a re-roof on Clearwater Beach need a city permit?

Yes. Clearwater Beach is part of the city, so the permit comes from the City of Clearwater's Permitting office, the same as on the mainland. Florida requires a permit for a re-roof (FBC-B 105.1) and two inspections: sheathing, usually at dry-in, and the roofing inspection (FBC-B 110.3). Beach houses also face the city's harshest weather; a USGS sensor there read 6.75 feet above mean higher high water in Helene. If you can, schedule the tear-off outside the mid-August to mid-October stretch when most hurricane activity occurs.

What must a Clearwater roof contract say under Florida law?

At least two notices. Fla. Stat. 489.147 requires every residential roof contract to state that the contractor may not offer a rebate, gift, deductible waiver or anything of value for a roof inspection or an insurance claim; without that notice, the owner may void the contract within 10 days. The signature page must also say, in bold type of at least 14 points, that if the work relates to a claim the owner should check coverage, deductibles and policy terms with the insurer before signing. The City of Clearwater's Permitting office issues the permit, but these terms sit between you and the contractor.

Does a Clearwater shingle re-roof need new drip edge?

Yes, at the eaves and gables. The residential code requires drip edge on shingle roofs, lapped at least 3 inches, extending half an inch below the sheathing, installed over the underlayment and nailed no more than 12 inches apart, tightened to 4 inches where the design wind speed (Vasd) is 110 mph or more or the mean roof height tops 33 feet (FBCR R905.2.8.5). Milton brought hurricane conditions from Clearwater Beach southward in 2024, and roof edges are where that kind of wind gets its first grip.
